Terms of Service

1. Acceptance of Terms

By installing, accessing, or using ClothCast ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not install or use the App.

2. Description of Service

ClothCast is a Shopify application that provides AI-powered virtual try-on for clothing products. Our services include:

• Virtual try-on image generation using AI
• Selfie upload and management
• Customizable storefront widget
• Analytics and conversion tracking
• Before/after image comparison

3. Account and Registration

To use ClothCast, you must have a valid Shopify store. By installing the App, you:

• Confirm you are authorized to act on behalf of the Shopify store
• Grant us read-only access to product data (read_products scope)
• Agree to maintain the security of your Shopify account

4. Subscription Plans and Billing

4.1 Available Plans

• Free: 10 try-ons/month, $0/month
• Starter: 250 try-ons/month, $19/month
• Pro: 1,000 try-ons/month, $49/month
• Enterprise: 10,000 try-ons/month, $299/month

4.2 Billing

All billing is processed through Shopify's Billing API. Charges appear on your Shopify invoice.

4.3 Usage Limits

Try-on counts reset on the first day of each billing cycle. Unused try-ons do not roll over.

5. End Customer Data

Your customers' selfie photos are handled with strict privacy controls:

• Photos are stored for a maximum of 24 hours and automatically deleted
• Photos are linked to anonymous session tokens, not customer accounts
• No biometric data is extracted or stored
• You are responsible for disclosing the use of virtual try-on AI in your store's privacy policy

6. Acceptable Use

You agree not to use ClothCast to:

• Generate content that is illegal, harmful, or violates third-party rights
• Attempt to circumvent usage limits or billing systems
• Reverse engineer, decompile, or extract source code from the App
• Use the service for non-clothing products in a misleading manner
• Collect or store customer photos beyond what the App provides

7. Intellectual Property

7.1 Our Intellectual Property

ClothCast, including its design, features, and technology, is owned by us and protected by intellectual property laws.

7.2 Generated Content

You and your customers may use AI-generated try-on images for personal shopping purposes. We make no claims of ownership over generated images.

8. AI-Generated Content Disclaimer

ClothCast uses AI to generate virtual try-on images. You acknowledge that:

• AI-generated images are approximations and may not perfectly represent how clothing will look
• Results depend on photo quality, lighting, and pose
• The AI may not perfectly preserve facial identity (this is a known limitation of the technology)
• Virtual try-on results should not be the sole basis for purchase decisions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ClothCast is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• We are not responsible for customer purchasing decisions based on AI-generated images

10. Termination

10.1 By You

You may terminate by uninstalling the App. No refunds for partial billing periods.

10.2 By Us

We may suspend or terminate access for Terms violations or at our discretion.

10.3 Effect of Termination

Upon termination, all data is deleted per our Privacy Policy. Customer selfie data is deleted within 24 hours regardless.

11. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance of updated Terms.
